What is A Buck And A Dream Safelist
A Buck And A Dream Safelist is a DOUBLE OPT-IN mailing list that allows members to send
their promotional offers to other members through a web interface provided by A Buck And
A Dream Safelist.
In exchange for sending their promotional offers to others, members agree to receive
promotional offers from other members at the "subscribe address" provided by the member
at the time of signing up. The frequency that members may send their promotional
materials is set by the admin of A Buck And A Dream Safelist and is determined by
the membership level.
Members may also receive certain types of messages from the admin of A Buck And A Dream
Safelist sent to the member's "contact address" provided at the time of signing up.
All members agree to receive messages as described
below, sent to their "contact address" from the
admin of this list. The types of messages that
might be sent are:
A. Admin Messages
These types of messages are non-commercial messages that will
be sent on as an "as needed" basis regardless of whether any
other messages are scheduled for sending. These types of
messages includes but is not limited to the following:
1. Updates and/or changes to the site, member benefits, policies,
etc.
2. Messages addressing specific or general violations of the
"Terms of Use" policies
3. Messages sent to confirm the validity of a Member's email
address
4. Messages sent to verify whether the Member's address is
connected with prohibited tools such as spam filters and
autoresponders
B. Solo Ads
The admin of this list may offer for purchase, Solo Ads [SAs],
to be sent to All FREE Members of this list on behalf of others,
in accordance with the following provisions:
1. In no case will more than 4 SAs may be sent in any given Sunday
through Saturday period.
2. In no case will more than 2 SAs be sent in any given day
C. Commercial Admin Messages
The admin of this list may from time to time send Commercial Admin
Messages [CAMs] TO ALL LIST MEMBERS of this list in accordance with
the following provisions:
1. No more than 3 CAMs will be sent in any given Sunday through Saturday
period.
2. No CAMs will be sent on any day when SAs are scheduled
for sending.

Banner impressions are/will be served on our network of safelists, affiliated sites and/or partner sites
to active paid members of this safelist until such time that the services provided by this safelist are
no longer available through the current administrator and/or the safelist becomes inactive.
The member must provide to the list admimistrator the following information:
1) Image Url Of The Banner Ad (468 x 60 in size)
2) Destination Url
Depending on the level of membership, the member shall have up to 5 banners rotated. The member may
provide banners to promote the same URL, however the member may not submit for inclusion, the same banner
more than once.
Advertising for sites (including redirecting to such sites) containg objectionable content; adult/pornograpy;
illegal activities including but not limited to warez, hacking, illegal downloads, etc.; pyramid schemes,
and/or hate, will be rejected. This list is not all inclusive and may be modified at any time.
Should the member submit for advertising a site which falls into the above category, the member will forfeit
any right to advertise under this agreement.
The administrator of this list reserves the right to reject ANY banner/URL as the administrator
so chooses whether or not such advertising is expressly prohibited.
Affiliate Commissions
Commissions are/will be paid to active members whose
membership level meet the conditions as stated in either a)this site's
home page or b)in the member affilate located which can be accessed by
logging into one's account for paid member referrals.
Payment of commissions will be made to all active members on a recurring
monthly basis provided the amount due is equal to or greater than $5.00. No member
shall be paid any commissions which does not meet or exceed the minium amount
for payment. Should a member cancel their account or should any member's
account be terminated prior to reaching the minimum required for payment, such
commissions shall be forfeited.
All payments shall be made by PayPal in US Dollars only. No other payment
options are currently available.
No member shall promote or attempt to promote this list in a manner that is
unethical, deceitful or against any law, rule or policy.
The use of SPAM/UCE, Bulk Mail and/or purchased email addresses in the promotion
of any service provided by A Buck And A Dream Safelist.com is strictly prohibited.
The promotion of this list in newsgroups and forums is acceptable ONLY in cases where such
promotion is appropriate for the newsgroup or forum and such promotion does not
violate such newsgroup's or forum's rules, policies or regulations.
Should any member be found to have violated any condition of this list's terms shall
be subject to the deletion of his/her account and the forfeiture of any commissions
due and/or any future commissions whether or not such commissions meet or exceed
the minimum amount required for payment of such commissions.
Service Interruptions/Termination
The member understands and agrees that all features including but not limited to posting times, email cleaning times, url trackers and saved messages may be changed, discontinued or interrupted at any time with or without prior notice.
The administrator of this list shall not be held liable nor provide refunds,
in whole or in part, as a result of the discontinuation or interruption of;
or changes in any feature of this safelist; the interruption or discontinuation
of the safelist; or any changes, interruptions or the discontinuation of any
service promoted by or made available through this safelist.
Account Cancellation/Termination
Members may cancel or terminate their subscription at any time.
Upon the cancellation or termination of any paid subscription whether by the member or the administrator of this list,
all benefits obtained through the the subscription shall be immediately terminated as of the date of
cancellation or termination.
No refunds are given for any services not provided after a member's account has been cancelled or
terminated regardless of whether the termination or cancellation occurs on the first day of the
subscription period or the last.
RELATIONSHIP OF THE PARTIES
Nothing contained in this Agreement shall be construed as creating any agency, legal representative,
partnership or other form of joint enterprise between the parties. Neither party shall have authority
to contract for or bind the other in any manner whatsoever.

FORCE MAJEURE
If by reason of failures of telecommunications or internet service providers, labor

of Abuckandadreamsafelist.com, Abuckandadreamsafelist.com is unable to perform in whole or in part its
obligations as set forth in this Agreement, then Abuckandadreamsafelist.com shall be relieved of
those obligations to the extent it is so unable to perform and such inability to perform shall not
make Abuckandadreamsafelist.com liable to the user of such services.
GOVERNING LAW
Ohio law shall govern this Agreement and any dispute arising from the relationship
between the parties to this Agreement. Any law pertaining to any other jurisdiction shall be
excluded.
In any litigation, arbitration, or other proceeding by which
one party either seeks to enforce its rights under this Agreement (whether in contract, tort,
or both) or seeks a declaration of any rights or obligations under this Agreement, the prevailing
party shall be awarded its reasonable attorney fees, and cost and expenses incurred, subject
to the Limitation of Liabilities clause. The parties consent to the exclusive jurisdiction and
venue of the courts of the State of Ohio or to any Federal Court located within the State
of Ohio.
ARBITRATION
Any legal controversy or legal claim arising out of or relating to this Agreement or our
services shall be settled by binding arbitration before the American Arbitration Association.
Any such controversy or claim shall be arbitrated on an individual basis and shall not be
consolidated in any arbitration with any claim or controversy of any other party.
The arbitration shall be conducted in Ohio as the parties to this agreement agree to be
governed by the laws of Ohio. Either party may seek any interim or preliminary relief from a
court of competent jurisdiction in Ohio as necessary to protect the rights or property of the
party pending the completion of arbitration. The prevailing party from arbitration shall be
entitled to reasonable attorney's fees which shall be set forth by the arbitrator(s). Judgment
upon the award rendered may be entered in any court in the state of Ohio with jurisdiction.
The decision of the arbitrator shall be final and binding on the parties. The parties shall
bear equally all fees, costs and expenses of the arbitration and each party shall bear its own
legal expenses, attorneys fees, and costs of all experts and witnesses, provided. However,
the arbitration panel may apportion between the parties, as said arbitrator may deem
equitable, the cost incurred by either party.
Should either party file an action contrary to this provision, the other party may
recover attorneys' fees and costs up to one thousand ($1000) dollars.
SEVERABILITY
If any provision of this Agreement shall be held to be invalid or unenforceable
for any reason, the remaining provisions shall continue to be valid and enforceable.
INDEMNIFICATION
You agree to defend, indemnify and hold harmless Abuckandadreamsafelist.com against any and all
claims, losses, penalties, causes of action, damages, liability, costs, expenses (including
but not limited to reasonable attorneys' fees) or claims caused by or resulting indirectly
from your use of the Abuckandadreamsafelist.com service, without limitation or exception, including
your violation of any third-party's rights, (including, without limitation, infringement of
any copyright trademark, service mark, trade secrets, right of privacy or publicity or any
other third party right). The terms of this section shall survive the termination of your
relationship with Abuckandadreamsafelist.com.
REMEDY
You agree that your sole and exclusive remedy to any issues relating to the
Abuckandadreamsafelist.com's SERVICES is to discontinue using the services provided.
ASSIGNMENT
In the event of a merger or consolidation of Abuckandadreamsafelist.com the surviving or new
corporation and any subsidiaries are similarly subject to the rights and obligations
of this Agreement.
ENTIRE AGREEMENT
Unless otherwise specified herein, this Agreement constitutes the complete and exclusive
Agreement between the parties regarding the products and/or services provided
hereunder and supercedes any prior Agreements between the parties with respect thereto.
WAIVER
The failure of Abuckandadreamsafelist.com to enforce a provision of this Agreement
shall not be construed as a waiver or limitation of Abuckandadreamsafelist.com's right
to subsequently enforce and compel strict compliance with every provision of this
Agreement.
MODIFICATION OF TERMS
Abuckandadreamsafelist.com reserves the right to modify this policy at any time and without
advance notice, effective upon making the modified provisions available on the Abuckandadreamsafelist.com Web Site. You are responsible for regularly reviewing these documents.
Continued use of the Abuckandadreamsafelist.com services after any such changes shall constitute
your consent to such changes. Abuckandadreamsafelist.com does not and will not assume any obligation

2.1 You represent and warrant that you, as the person legally responsible

under 18 years of age, you must have parental consent in order to sign up for

parent or legal guardian in their own name.
2.0 UNLAWFUL / PROHIBITED USE

purposes only. You are responsible for keeping a copy of your most current web
site files as backup on a remote system.
3.2 Abuckandadreamsafelist.com is not responsible for any lost files, information, or data.
However, if any loss of data occurs due to an error on the part of Abuckandadreamsafelist.com,
Abuckandadreamsafelist.com will use reasonable efforts to recover the data at no charge to you.
If data loss occurs due to client negligence in securing an account or for any other action
on the part of the client, Abuckandadreamsafelist.com will use reasonable efforts to recover the
data from the most recent archive for a fifty ($50.00) dollar fee.

Streaming Audio or Video
4.5 Illegal Archives (audio, video and program archives/downloads)
Sexually explicit, obscene or pornographic content (whether in text or graphics)
4.6 Content, speech, images or domains that are offensive, profane, promote hatred or
ill will toward others, threatening, harmful, defamatory, libelous, harassing,
discriminatory (whether based on race, ethnicity, creed, religion, gender, sexual
orientation, physical disability or otherwise) or that promote any illegal activity.
4.7 Content, speech, images or domains that mock, ridicule or otherwise damage the reputation
and/or goodwill of Abuckandadreamsafelist.com or any Abuckandadreamsafelist.com associate whether or not
such is intended.
4.8 Graphic violence.
4.9 Any other script, program or site that is illegal or that consumes a disportionate
amount of the server's resources.

any of the following types of sites:

to these requirements.
5.0 MESSAGE CONTENT
5.1 You agree not to use Abuckandadreamsafelist.com's services to send any messages or material
that are unlawful, harassing, libelous, abusive, threatening, harmful, vulgar,
obscene or otherwise constitute a criminal offense, give rise to civil liability or otherwise objectionable material of any kind or nature or that encourages conduct that could constitute
a criminal offense, give rise to civil liability or otherwise violate any applicable
local, state, national or international law or regulation. You understand that
you are solely responsible for the content of any messages sent using the services
provided by Abuckandadreamsafelist.com.
5.2 Abuckandadreamsafelist.com reserves the right to terminate your account if Abuckandadreamsafelist.com
becomes aware and determines at Its sole discretion, that you are violating any of the foregoing guidelines.
6.0 ZERO TOLERANCE SPAM POLICY
6.1 Abuckandadreamsafelist.com takes a zero tolerance stance against the sending of unsolicited email,
commonly known as spam. Any user who sends out spam will have their account terminated
without notice and may be charged a one time administration
fine of one hundred ($100) dollars upon the demonstration of proof that the user
sent the email utilizing the services provided by Abuckandadreamsafelist.com.
6.2 Abuckandadreamsafelist.com reserves the right to require changes or disable as necessary any web
site, account, database, or other component that violates this policy at its
sole discretion.
7.0 SERVICE PROVIDER'S RIGHTS
7.1 You agree that Abuckandadreamsafelist.com has the right to monitor its services and/or
any accounts that utilizes such services and to disclose any information as necessary
to satisfy the law, or to protect itself or its clients.
7.2 Abuckandadreamsafelist.com reserves the right to remove any information or materials in whole
or in part that in its sole discretion, deems to be unacceptable, undesirable, or in
violation of this agreement. Such information or materials may be removed by
Abuckandadreamsafelist.com without prior notice to the client.
7.3 Abuckandadreamsafelist.com also reserves the right to refuse refunds in cases where Abuckandadreamsafelist.com
believes abuse has taken place.
7.4 Abuckandadreamsafelist.com reserves the right to monitor any and all communications
through or with our facilities. You agree that Abuckandadreamsafelist.com is not considered
a "secure communications medium" for the purposes of the ECPA, and that no expectation
of privacy is afforded.
8.0 SHARING OF ACCOUNT SPACE / RESELL RESTRICTIONS
8.1 You agree that you are solely responsible for all use of your account.
8.2 You represent and warrant that the account purchased is for your use only.
As such, you may not share, host, resell, rent, lease or give access to your

3.0 MESSAGE CONTENT
3.1 You agree not to use the services provided to send any messages or material
that are unlawful, harassing, libelous, abusive, threatening, harmful, vulgar,
obscene or otherwise constitute a criminal offense, give rise to civil liability or otherwise objectionable material of any kind or nature or that encourages conduct that could constitute
a criminal offense, give rise to civil liability or otherwise violate any applicable
local, state, national or international law or regulation. You understand that
you are solely responsible for the content of any messages sent using the services
provided by Abuckandadreamsafelist.com.
3.2 Abuckandadreamsafelist.com reserves the right to terminate your account if Abuckandadreamsafelist.com
becomes aware and determines at Its sole discretion, that you are violating any of the foregoing guidelines.
4.0 ZERO TOLERANCE SPAM POLICY
4.1 Abuckandadreamsafelist.com takes a zero tolerance stance against the sending of unsolicited email,
commonly known as spam. Any user who sends out spam will have their account terminated
without notice and may be charged a one time administration
fine of one hundred ($100) dollars upon the demonstration of proof that the user
sent the email utilizing the services provided by Abuckandadreamsafelist.com.
.2 Abuckandadreamsafelist.com reserves the right to require changes or disable as necessary any web
site, account, database, or other component that violates this policy at its
sole discretion.
5.0 SERVICE PROVIDER'S RIGHTS
5.1 You agree that Abuckandadreamsafelist.com has the right to monitor its services and/or
any accounts that utilizes such services and to disclose any information as necessary
to satisfy the law, or to protect itself or its clients.
5.2 Abuckandadreamsafelist.com reserves the right to remove any information or materials in whole
or in part that in its sole discretion, deems to be unacceptable, undesirable, or in
violation of this agreement. Such information or materials may be removed by
Abuckandadreamsafelist.com without prior notice to the client.
5.3 Abuckandadreamsafelist.com reserves the right to monitor any and all communications
through or with our facilities. You agree that Abuckandadreamsafelist.com is not considered
a "secure communications medium" for the purposes of the ECPA, and that no expectation
of privacy is afforded.
6.1 The member understands that his/her safelist will be hosted under a subdomain and that he/she will not have access to any other hosting resource unless otherwise provided for by Abuckandadreamsafelist.com
Furthermore the member understands that his/her use of the script provided shall be through the use
of the script's admin interface and that he/she has no ownership interest in the script nor will access to the script's source code.
8.0 SAFELIST SCRIPT USE RESTRICTIONS
Only one (1) instance of the script provided by may be installed under a subdomain account.
8.1 The member must at all times require that each subscriber to his/her list validate each email address used by the subscriber including the validation of the subscriber's contact email address. No list messages may be sent to any subscriber without following the double opt-in procedures.
8.1.1 The member MAY NOT VALIDATE A MEMBER'S EMAIL ADDDRESS(S) except in cases where the subscriber has demonstrated desire to opt in buy making a membership purchase.
8.2 The member must maintain an up to date "terms of service" policy stating the list's policies including but not limited to whether commercial email messages will be sent to the subscriber's contact address, the method for opting out of the list and other policies.
8.3 Footers containing opt out information and a link to the list's "terms of service" policies must remain in all email messages sent through any list.
8.3.1 The member may not use the services provided to send commercial messages to any list subscriber without a means for unsubscribing.
9.0 DATA BACKUP
Full back-ups are made weekly, and back-ups of new/changed data are made nightly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these back-ups. Back-ups are made for server restoration purposes only.
9.1 Backup options from the admin control panel shall be provided to the member to backup data. The
member is responsible for for making and keeping backups of the most current safelist files on
a remote system.
9.1.1 Abuckandadreamsafelist.com is not responsible for any lost files, information, or data. However, if any loss of data occurs due to an error on the part of THE HOSTING SERVICE, THE HOSTING SERVICE will use reasonable efforts to recover the data at no charge to THE CLIENT. If data loss occurs due to THE CLIENT's negligence in securing an account or for any other reason, THE HOSTING SERVICE will use reasonable efforts to recover the data from the most recent archive subject to a fee of $50.00.
